TERMS AND CONDITIONS FOR PROVIDING SERVICES BY ELECTRONIC MEANS
MyAlpaca sp. z o. o.

  1. General provisions.
    1. Under Article 8 paragraph 1 point 1 of the Act on providing services by electronic means of 18 July 2002 (Journal of Laws No. 144 item 1204, as amended), MyAlpaca sp. z o. o. hereby sets these terms and conditions for providing services by electronic means.
    2. These terms and conditions specify:
      1. the kind and scope of services provided by electronic means;
      2. terms for providing services by electronic means;
      3. conditions for concluding and terminating agreements for providing services by electronic means;
      4. complaint procedure.
  2. Definitions.For the purpose of these terms and conditions, terms in this § 2 will have the following meaning:
    electronic address designation of the information and communications technology system enabling communication via electronic means;
    third parties persons other than the service provider and recipient;
    Website a system of websites made available on the web server at myalpaca.eu, which constitutes a set of static and dynamic documents containing graphic files, scripts and other interconnected elements of the set;
    online store an online store run by MyAlpaca sp. z o. o. at https://shop.myalpaca.eu;
    parties the service provider and recipient;
    ICT system a group of cooperating IT devices and software, providing for processing, storing, and also sending and receiving data via telecommunications networks by means of a terminal equipment appropriate for the given type of network in the meaning of the Act on Telecommunications Law of 21 July 2000;
    means of electronic communication technical solutions, including information and communications devices and cooperating software tools enabling individual distant communication, using the data transmission between ICT systems, and in particular electronic mail;
    provision of service by electronic means the provision of the (distance) service without the simultaneous presence of the parties, by data transmission at an individual request of the recipient, sent and received by means of devices for electronic processing, including digital compression and storage of data, which is entirely broadcast, received or transmitted by means of the telecommunications network in the meaning of the Act on Telecommunications Laws of 16 July 2004;
    services services provided by electronic means;
    recipient an entity using the website;
    service provider MyAlpaca sp. z o.o. with its registered office in Krosno, ul. Pużaka 18, 38-400, entered in the register of entrepreneurs of the National Court Register kept by the District Court in Rzeszów XII Economic Division of the National Court Register under number KRS 0000524208, with NIP (Tax Identification Number) 6842639013, REGON (Business Statistical Number) 181151572, with the share capital of PLN 700,000 (the capital has been paid up in full).
  3. Kinds and scope of services provided by electronic means.
    1. The service provider provides the following services:
      1. information services;
      2. communications services;
      3. services in terms of organising the sale of products via the online store.
    2. Services are provided with the use of the website.
  4. Scope of information services.
    1. Information services consist in making available, at an individual request of the recipient, information placed within the website by displaying a site with certain URL address, containing information data individually requested by the recipient.
    2. Information services include in particular services within which the recipient receives general information regarding the service provider and the profile of his/her activity, workplaces offered by the service provider and also information about contact persons indicated by the service provider; the services referred to in this Section are used by specialised tabs within the website, including tabs ABOUT US, CRAFT, FARM, STORE, CONTACT, COOPERATION;
  5. Scope of communications services.
    1. Communications services consist in enabling, at an individual request of the recipient, communication with an appropriate department of the service provider.
    2. Communications services include in particular:
      1. services within which the recipient provides the service provider with information regarding recipient’s willingness to work for the service provider; a dedicated e-mail address biuro@myalpaca.pl in COOPERATION tab gives the possibility of using the services mentioned in this point;
      2. services within which the recipient provides the service provider with information regarding recipient’s willingness to cooperate with the service provider in terms of distribution of products of the service provider.
  6. Scope of services in terms of organising the sale of products via the online store.
    1. Services in terms of organising the sale of products via the online store consist in enabling the recipient to place orders for the products distributed by the service provider.
    2. Services referred to in Section 1 are provided with the use and functionality of the “store” tab; the functionality of the said tabs enables the recipient to place offers for the purchase of products distributed by the service provider.
    3. Detailed rules for the sale of products via the online store are specified in the terms and conditions of the online store.
  7. Conditions for providing services.
    1. In order to correctly use the services the recipient should have computer hardware and software with the following minimum requirements:
      1. browser in the latest available version Safari, Google Chrome, Firefox, Internet Explorer;
      2. display with a resolution of 1200×800;
      3. enabled Cookies and Java Script support.
    2. If the recipient uses the hardware and software which do not meet the technical requirements set forth in Section 1, the service provider does not guarantee the correct functioning of the application and reserves that this may have a negative impact on the quality of the services provided.
    3. For safety reasons, the service provider reserves the right to terminate connection with the recipient after the time not shorter than 2 minutes from the time of performing the last activity by the recipient.
    4. The provision of services electronically by the service provider is free of charge.
    5. It is prohibited to deliver by the recipient unlawful or insulting content and also to perform action which might cause disturbance or damage to the website.
  8. Conditions for concluding and terminating agreements for providing services by electronic means.
    1. These terms and conditions constitute an integral part of the agreements for providing services by electronic means, which are concluded by the service provider with the recipient.
    2. Agreements for providing services by electronic means are concluded by starting to use a given service by the recipient.
    3. These terms and conditions are made available via website myalpaca.eu in the form enabling downloading, saving and printing. In particular, the text of these terms and conditions may be saved on the disk and printed.
    4. Using the myalpaca.eu website by the recipient is tantamount to becoming familiar with these terms and conditions and to acceptance of these terms and conditions, as well as to concluding the agreement for the provision of services by electronic means.
    5. The recipient may at any time cease to use the service. If the recipient leaves the website myalpaca.eu, the agreement for the provision of services by electronic means is automatically terminated without the need to make additional statements of the parties.
  9. Cookies Policy.
    1. Cookies are short text files saved in the recipient’s system by the system of the service provider, which may be read only by the system which saved them.
    2. Cookies serve to analyse traffic on the website and the processing of an order.
    3. Within the website, the following kinds of cookies are used: first party cookies – placed directly by an owner of the visited website.
    4. Software used to surf websites may in many cases by default allow cookies in the terminal equipment. Such settings may be changed so as to block an automatic handling of cookies in the Internet browser settings or may inform each time when cookies are sent to the user’s equipment. Detailed information about the possibility and manners of handling cookies are available in the software (browser) settings.
    5. Restricting the use of cookies may affect some of the functionalities available on the site.

  10. Complaints.
    1. Recipients may make complaints regarding services.
    2. Complaints should be made in writing, by registered letter to the address: MyAlpaca sp. z o.o. with its registered office in Krosno, ul. Pużaka 18, 38-400, or via electronic correspondence to the address: craft@myalapca.pl.
    3. A correctly made complaint should contain at least the following data:
      1. designation of the recipient;
      2. order number;
      3. contact telephone number;
      4. description of the problem on which the complaint is based.
    4. The service provider shall make every effort to handle the complaints within 14 days of receiving them.
    5. Complaints without data referred to in Section 3 will not be handled.
  11. Final provisions.
    1. The service provider may block access to the website or its part due to important reasons, including in particular, cases when irregularities are found in the use of the website, including circumstances which might cause damage to the recipient or service provider.
    2. The service provider is not liable for temporary or permanent suspension of the website’s availability.
    3. The service provider is not liable for the up-to-date nature, accuracy and completeness of information presented within the website, as well as for its suitability for any action of the recipient.
    4. The service provider does not give any guarantee that using the website will be without errors, defects or interruptions or that given information within the website will meet the expectations of the recipient as to the substance, accuracy or suitability of obtained information.
    5. The service provider is not liable for using the website by the recipient in a manner incompliant with these terms and conditions.
    6. For any consequences resulting from incorrect filling in of the forms of myalpaca.eu website by the recipient, and in particular by providing by the recipient mistaken or false data, the recipient bears entire liability.
    7. The service provider reserves the right to make unilateral changes to these terms and conditions at any time, with effect to be binding in the future. Changes shall enter into force on the day of being published on the website myalpaca.eu.
    8. The service provider reserves the right at any time to:
      1. change data contained within the website;
      2. change technical parameters of the website;
      3. temporarily or permanently limit the website’s availability;
      4. withdraw entirely from the website

      at any time.

    9. Within the obligations connected with these terms and conditions, the liability of the service provider is limited towards the recipient to intentionally caused damage.
    10. The provisions of the Civil Code of 23 April 1964 and the Act of 18 July 2002 on the provision of services by electronic means will apply to matters not governed by these terms and conditions.
